
The rapid rise of Artificial Intelligence (AI) presents a defining moment in human history. The past years bore witness to both exhilarating progress and growing challenges surrounding AI’s expanding role in society. The advent of generative AI, capable of crafting human-quality text and visuals, has ignited widespread innovation. The deployment of these Generative AI systems and technologies has been observed in elections in many countries around the world. While the role of AI in African elections is still evolving, a small fraction of African electoral commissions are advanced in AI uptake for elections. A recent Yiaga Africa survey of electoral commissions in 22 African countries reveals that AI is being deployed for voter register management (South Africa), automated chatbots for voter engagement (Eswatini), voter authentication (Madagascar), and cyber threat detection (Nigeria). AI is addressing the challenge of human interference and inefficiency in elections by facilitating oversight and accelerated decision-making. Advanced analytics and machine learning models detect anomalies and inaccuracies in election data to avert election manipulation. Yet, this progress has also spurred concerns about safety, misuse, and misinformation.
As the specter of Artificial Intelligence (AI) looms over Nigeria’s future elections, injecting the potential for both unprecedented efficiency and catastrophic misuse, it is paramount to look toward one of the nation’s most robust regulatory regimes for a guiding blueprint: the Nigerian Aviation Sector.
The absence of a comprehensive, dedicated AI Act for electoral processes leaves the democratic space vulnerable to threats like deepfakes and algorithmic bias. However, the regulatory history of the Nigerian Civil Aviation Authority (NCAA) offers a compelling pattern of proactive, risk-based, and compliance-driven governance that could stabilize the volatile field of election technology.
The Aviation Model: A Framework of Mandatory Safety
Nigeria’s aviation sector, governed primarily by the Civil Aviation Act, 2022, and the Nigerian Civil Aviation Regulations (NCAR), operates on a principle of uncompromising safety and compliance that aligns with global standards set by the International Civil Aviation Organization (ICAO). This framework is built on three pillars that are profoundly relevant to electoral AI regulation:
Centralized, Expert-Driven Regulator: The Nigerian Civil Aviation Authority (NCAA) is the sole regulator for civil aviation, empowered to issue licenses, enforce safety standards, and conduct oversight.
The Pattern for Elections: The Independent National Electoral Commission (INEC) should be empowered as the primary AI regulator for elections. Akin to the NCAA’s technical expertise in airworthiness, INEC must establish a dedicated, technically proficient AI Compliance Unit staffed by data scientists and legal experts. This unit would be responsible for issuing AI “Certificates of Safety” for any system deployed by political parties or the Commission itself.
High-Risk Certification and Licensing: In aviation, operators require an Air Operator’s Certificate (AOC) and their aircraft must undergo rigorous airworthiness certification. Operations are halted if safety is compromised.
The Pattern for Elections: An AI application intended for use in an election—such as a voter demographic analysis tool, a social media monitoring algorithm, or any generative AI for campaign material—should be designated as “High-Risk” and require a mandatory “Electoral AI Certification” from the INEC-AI Compliance Unit. This certification would ensure the system meets minimum standards for:
Algorithmic Transparency and Explainability: The logic of the AI’s decision-making must be auditable, much like a flight recorder.
Bias and Fairness Audits: Mandatory testing to ensure the AI does not discriminate against any demographic or political group, mirroring the strict testing of aircraft components.
Data Provenance and Security: Verification that the training data is legitimate and the system is cyber-secure, a parallel to regulating air traffic control safety.
Clear Liability and Sanctions: The aviation sector has clear lines of liability for non-compliance, including the grounding of aircraft and hefty fines, ensuring accountability in a high-stakes environment where errors cost lives.
The Pattern for Elections: Regulation of electoral AI must establish strict civil and criminal penalties for the malicious deployment of AI, such as deepfakes designed to sway votes or algorithms used to suppress voter turnout. Just as an airline can lose its license for compromising safety, a political entity that deploys an uncertified, harmful AI system should face sanctions that include campaign funding revocation and criminal prosecution for individuals involved.
The Urgent AI Challenge
Currently, AI regulation in Nigeria is fragmented, relying mostly on the Nigeria Data Protection Act (NDPA, 2023) and general provisions of the Cybercrimes Act, 2015. While the NDPA touches on algorithmic accountability, it is a general framework, not an election-specific safety code.
The parallel to the aviation sector is critical because, like air travel, elections are a “high-consequence environment.” In aviation, a single failure can lead to mass casualties. In an election, an unchecked AI deepfake or bias in a voter roll can lead to democratic collapse, social unrest, and a loss of public trust.
Adopting the aviation model—where safety is non-negotiable and is assured through pre-emptive, centralized, and expert-enforced certification—is the most effective way to harness the benefits of AI for Nigerian democracy while guarding against its existential threats. The time for a general framework is over; the complexity and risk of AI in the democratic process demand a sector-specific “Airworthiness” standard before the nation faces an irreversible digital crash.
